2010 Report on International Religious Freedom - Egypt

Law 263 of 1960, still in force, bans Baha'i institutions and community activities and strips Baha'is of legal recognition. During the Nasser era, the government confiscated all Baha'i community properties, including Baha'i centers, libraries, land for the House of Worship, cemeteries, and more.

The government requires all citizens to be categorized as Muslims, Christians, or Jews on national identity cards. Baha'is have been compelled either to misrepresent themselves or to live without valid identity documents.

In 2008 the Cairo Administrative Court ruled in three cases brought by Baha'is that the government must issue official identification documents containing a dash or other mark in the religion field.

The ruling stated that anyone who adopts the Baha'i Faith is an apostate and that the religion cannot be recorded in any civil status or other official document, because that would conflict with public order.

According to Baha'i community members, throughout the first half of 2010 the government implemented the order and reportedly issued more than 180 birth certificates and 50 to 60 national identification cards to Baha'is, all with dashes in the religious identification field. The government, because it does not recognize Baha'i marriage, and there is no civil mechanism for marriage, refused to issue identification documents to married Baha'is, unless they would agree to specify their marital status as "unmarried." According to the government, it was attempting to find a mechanism to issue identification documents to married Baha'is that would correctly identify marital status.

While the government complied with court rulings by issuing identity documents with a “dash” for religion to unmarried Baha’i, it continued to refuse to issue marriage certificates. This made it impossible for married members of the Baha'i community to obtain identity documents recognizing their marital status. The government cited its nonrecognition of the Baha'i Faith and the country's lack of a civil marriage mechanism as reasons for the denial.

During the reporting period, the government did not investigate or prosecute the perpetrators of a March 2009 attack on the homes of seven Baha'i families in the village of al-Shuraniya in Sohag Governorate. Muslim villagers, some of them related to the Baha'i villagers, attacked Baha'i houses with bricks and rocks until police dispersed them. On March 31, the attacks escalated when attackers returned and set fire to the homes, forcing the Baha'is to flee.

The Constitution provides for freedom of belief and the practice of religious rites, although the Government places restrictions on these rights in practice. Islam is the official state religion, and Shari'a (Islamic law) is the primary source of legislation.
Although there were some positive steps in support of religious freedom, the status of respect for religious freedom by the Government declined overall during the period covered by this report. Members of non-Muslim religious minorities officially recognized by the Government generally worship without harassment and maintain links with coreligionists in other countries. However, members of religious groups that are not recognized by the Government, particularly the Baha'i Faith, experience personal and collective hardship.

A lower court ruling interpreted the Constitution's guarantee of religious freedom as inapplicable to Muslim citizens who wish to convert to another religion. This ruling is under appeal. Separate court rulings provided for 13 Christian born converts to Islam to obtain identity documents indicating their conversion back to Christianity and allowed some Baha'is to obtain civil documents. However, the courts included requirements effectively identifying the Christian converts and Baha'is as apostates, potentially exposing them, if implemented, to risk of significant discrimination by both governmental and societal agents. In addition, a lower court held that the Constitution's guarantee of freedom of religion does not apply to Baha'is.

There continued to be religious discrimination and sectarian tension in society during the period covered by this report. There were several violent incidents in Upper Egypt, including an attack by Bedouins on the Abu Fana monastery, arson attacks on Christian-owned shops in Armant, and an attack on a Coptic Church and Coptic-owned shops in Esna. Muhammad Higazy, who converted from Islam to Christianity, received death threats and went into hiding with his wife after his case received wide attention in the Arabic language media.

The Ambassador, senior administration officials, and members of Congress continued to raise U.S. concerns about religious discrimination with senior government officials. Specifically, embassy officers and other U.S. State Department officials raised concerns with the Government about ongoing discrimination faced by Christians in building and maintaining church properties, official discrimination against Baha'is, and the Government's treatment of Muslim citizens who wish to convert to other faiths.

The Government has asserted that national identity cards require all citizens to be categorized as Muslims, Christians, or Jews. The MOI has reportedly, on rare occasions, issued documents that list a citizen's religion as "other" or simply do not mention religion; however, it is not clear when these conditions apply. Baha'is and other religious groups not associated with any of the three "heavenly religions" have been compelled either to misrepresent themselves or go without valid identity documents.

Those without valid identity cards also encounter difficulty registering their children in school, opening bank accounts, and establishing businesses. Baha'is at age 16 face additional problems under Law 143/1994, which makes it mandatory for all citizens to obtain a new identification card featuring a new national identification number. Police occasionally conduct random inspections of identity papers and those found without identity cards can be detained until the document is provided. Some Baha'is without identity cards reportedly stay home to avoid police scrutiny and possible arrest.

Restrictions on Religious Freedom

The Cairo Administrative Court, a court of first impression, in its January 29, 2008 rulings in the case of Hasan Husni Naguib 'Abd-al-Masih (a Baha'i) vs. the Minister of Interior (Action No. 12780 of JY 61) interpreted the country's constitutional provision of freedom of opinion and belief to mean that non-Muslims are free to adopt Islam, free to continue in their faith, and free from compulsion to convert to Islam. However, it stated that the freedom to practice religious rites is subject to limits, especially the maintenance of public order, public morals, and conformity to the provisions and principles of Islam, which forbid Muslims to convert. The Court stated that "public order" is defined as the official religion being Islam, that most of the population professes Islam, and that Islamic law is the primary source of legislation.

The trial court's January 29, 2008, ruling in three cases brought by members of the small Baha'i minority held that the Government must issue official identification documents containing a dash or other mark in the religion field. Despite the positive aspects of the ruling, there were also restrictive aspects.

The Court noted that a purpose of filling the religion field with a dash or other distinctive mark was to protect members of the "revealed religions"--Judaism, Christianity, and Islam--from Baha'i infiltration and avoid potential dangers from such persons' conduct and relations with them. The ruling stated that anyone who adopts the Baha'i Faith is an apostate and that the religion cannot be recorded in any civil status or other official document, because that would conflict with public order. In a statement published in the January 31, 2008 edition of Cairo's Rose al-Yousef newspaper, Al-Azhar University, through its Islamic Research Council, expressed its support of the 29 January court ruling. Members of the council affirmed that the Administrative Court ruling allowing these Baha'is to leave the religion section vacant or to enter the word "other" does not violate the prior decision of the Islamic Research Council, which did not recognize the Baha'i Faith as a congregation, a societal, political or religious entity.

In a discussion organized by the National Council for Human Rights on June 6, the MOI confirmed that it intended to implement the January 29 ruling as soon as a legal challenge was resolved.

The decision followed a December 16, 2006, Supreme Administrative Court ruling deciding that Baha'is may not list their religion in the mandatory religion "field" on obligatory government identity cards. In May 2006 the MOI had appealed an administrative court ruling issued in April 2006 which supported the right of Baha'i citizens to receive identity cards and birth certificates with the Baha'i religion noted on the documents. In response to requests to remove the religion field from national identity cards, the Government insisted that such identification was necessary to determine which laws apply in civil cases. This policy required Baha'is to dissimulate that they were adherents of Judaism, Christianity, or Islam, to obtain necessary civil documents. The Government stated that all citizens must be in possession of new computerized identification cards by January 1, 2007, and that old, hand-written cards would no longer be valid. However, in May 2007 the Government extended the deadline for the use of the old identity cards as a temporary measure until January 2008. The Government has issued passports for Baha'i citizens. (National passports do not indicate the holder's religion.) Citizens not in possession of valid identity documents may be subject to detention.

The Baha'i Faith in Egypt - Almasry Alyoum

Approximately three weeks ago, I raised the issue of two children, namely 6-year-old Nour and 3-yeard-old Hana. The British School in New Cairo refused to move Nour from the kindergarten to the primary stage and to admit Hana in the kindergarten. The reason was that their documents did not include an electronic birth certificate, but only a paper one

There is no solution to that problem because their father, Wassim Kamal Eddin, is a Bahai, but his religion is not officially recognized as a religion by the Civil Affairs Administration, which therefore refuse to issue a national ID number for its followers.

No officials offered a solution to Kamal's problem. Yet, they just had to accept a simple solution suggested by Kamal, namely that the two children should be admitted with the paper certificate till a court ruling recently issued by the Administrative Judiciary Court is put into effect.
The ruling says that a dash will be put in the religion space in the certificate for those who embrace a religion other than those recognized in Egypt.

Last week, I received a message from Kamal saying that after the efforts made by the Secretary General of the National Council for Human Rights Mokhles Qotb and the Egyptian initiative for personal rights run by Hossam Bahgat, Education Minister Yosri el-Gamal sent two employees from his office and the head of the Primary Education Directorate in New Cairo to the school.
After negotiations, the school administration decided to enroll Nour again in the school and to admit Hana to the kindergarten, provided that they study one of the two recognized religions. This was accepted by their father. The school stipulated that the father brings the electronic certificates before mid-December.

Although el-Gamal deserves appreciation for his intervention to save those two innocent children's future, the problem is still unsolved, not only because the two children could be dismissed in a few weeks' time, but also because the problem concerns several other Egyptian Bahais. Indeed, administrative bodies insist on not giving them any official documents recognizing their religion.

These organs offer them to write one of the three recognized religions in the religion space in their documents, otherwise they will have no official documents. The bodies had taken official documents away from them that recognized their religion.

The gross error made by governmental organs is that they deal with the issue of Bahaism as a religious issue and adopts their views and take their decisions on the basis of statements and opinions by Al-Azhar Grand Sheikh and the Islamic Research Academy regarding Islam's stance on Bahaism.

As far as the State is concerned, this is a civil and constitutional, rather than religious, affair.
Followers of any religion do not recognize other religions and ideologies; Jews do not recognize Christianity or Islam, and neither do Muslims and Christians with other religions.

The State does not have the right to favor followers of a certain religion at the expense of other religions. This means that it deprives the others of freedom of belief and persecutes them.A national State basically includes citizens of different colors, races, religions and political ideologies. These citizens agreed on protecting each other's freedom of belief. They are equal in rights and duties.

Their constitution is based on these facts and they elected a government to enforce it. This government does not have the right to impinge on the rights of any individual simply because he or she embraces a different religion.

This is the issue or, so to speak, the farce. When we failed to understand it, we deprived two Egyptian children from the simplest citizenship rights, namely having a birth certificate; and the reason is that they embrace a religion other than the one we follow.


في أصول المسألة البهائية


منذ حوالي ثلاثة أسابيع أثرت في هذا المكان، مشكلة الطفلتين «نور» ٦ سنوات و«هنا» ٣ سنوات اللتين رفضت المدرسة البريطانية بالقاهرة الجديدة، نقل أولاهما من الحضانة إلي المرحلة الابتدائية، ورفضت قبول الثانية بمرحلة الحضانة، لأن أوراق التقديم تخلو من مستند مهم، هو شهادة الميلاد الإلكترونية، وتقتصر علي شهادة الميلاد الورقية، وهي مشكلة لا حل لها، لأن والدهما وسيم كمال الدين نصير يدين بالبهائية، التي لا تعترف بها مصلحة الأحوال المدنية، وترفض استخراج بطاقة الرقم القومي لمن يدين بها، إلا إذا قبل أن ينتقل منها إلي إحدي الديانات السماوية الثلاث، وبالتالي فهو لا يستطيع استخراج شهادة ميلاد إلكترونية لبناته،
وكان عليه أن يدوخ السبع دوخات، بين الإدارات التعليمية، من دون أن يجد مسؤولاً يحل له مشكلته، ويحول دون ضياع مستقبل ابنتيه، ويقبل الحل البسيط الذي اقترحه، وهو قبول الطفلتين بالشهادة الورقية إلي حين تنفيذ الحكم الذي أصدرته محكمة القضاء الإداري أخيراً، بأن توضع «شرطة» أمام خانة الديانة، لمن يدينون بغير الأديان المعترف بها في مصر.
وفي الأسبوع الماضي، تلقيت رسالة من الأستاذ وسيم كمال الدين والد الطفلتين يقول فيها، إن الجهود التي بذلها السفير مخلص قطب، الأمين العام للمجلس القومي لحقوق الإنسان، والمبادرة المصرية للحقوق الشخصية،
التي يديرها الأستاذ حسام بهجت، وما أثارته الصحف، قد انتهت بأن أرسل وزير التربية والتعليم د. يسري الجمل اثنين من العاملين في مكتبه، فضلاً عن مدير التعليم الابتدائي بالقاهرة الجديدة، إلي المدرسة،
وتقرر ـ بعد التفاوض ـ أن يعاد قيد «نور» وأن تلحق «هنا» بالحضانة، علي أن تدرسا إحدي الديانتين المعترف بهما، وتكون مادة نجاح ورسوب، وهو ما وافق عليه ولي أمرهما، علي أن يتقدم قبل منتصف ديسمبر المقبل بشهادة الميلاد الإلكترونية.. وإلا..
ومع أن الدكتور «يسري الجمل» يستحق الشكر، لأنه تدخل لإنقاذ مستقبل هاتين الطفلتين البريئتين، اللتين كاد مستقبلهما يضيع بسبب لا ذنب لهما فيه، ولا علم لهما به،
فإن المشكلة لا تزال قائمة، ليس فقط لأن خطر الفصل من المدرسة يحيق بهما بعد أسابيع قليلة، ولكن ـ كذلك ـ لأن المشكلة لا تقتصر عليهما، بل تطول غيرهما من المصريين البهائيين، وتسبب لهم مشاكل لا حصر لها، نتيجة إصرار الجهات الإدارية علي عدم منحهم أي أوراق ثبوتية، تتضمن الإشارة إلي ديانتهم، وتخييرها لهم،
بين تسجيل إحدي الديانات السماوية الثلاث، أمام خانة الديانة في هذه الأوراق، أو يظلون بلا أوراق ثبوتية، يتعاملون بها مع الآخرين، بعد أن لجأت هذه الجهات إلي سحب ما لديهم من أوراق رسمية، كانت تعترف بهذه الديانة من قبل.
والخطأ الرئيسي الذي تقع فيه الهيئات الحكومية هي أنها تتعامل مع المسألة البهائية، باعتبارها مسألة دينية، وتستند في نظرتها وقراراتها نحوها، إلي تصريحات وفتاوي أو آراء لفضيلة شيخ الأزهر أو لمجمع البحوث الإسلامية تتعلق بموقف الإسلام من البهائية، في حين أن المسألة ـ فيما يتعلق بالدولة تحديداً ـ مدنية ودستورية وليست دينية..
فأتباع كل الأديان والمذاهب الدينية، ينكرون الأديان والمذاهب التي يؤمن بها غيرهم، فاليهود لا يعترفون لا بالمسيحية ولا بالإسلام، وبعض مذاهبهم تنكر الأخري، والمسيحيون لا يعترفون باليهودية كما يفهمها اليهود،
ولا بالإسلام، وبعض مذاهبهم تنكر الأخري، والمسلمون، يعترفون بالمسيحية واليهودية، ولكنهم يعتبرون أتباعهما قد حرفوا الكتب التي نزلت علي رسلهم، فضلاً عن أن من بينهم من ينكر الإسلام علي أتباع المذاهب الإسلامية التي تختلف مع مذهبه!
وإذا كان من حق أتباع كل دين وكل مذهب ديني، أن يؤمنوا بما شاءوا وحسابهم علي الله عز وجل، فليس من حق الدولة، أن تنحاز لرؤية أتباع دين أو مذهب معين من رعاياها، عن غيره من الأديان والمذاهب، لأن معني ذلك أن تصادر حق الآخرين في اعتقاد ما يشاءون، وأن تقنن اضطهادهم أو التمييز ضدهم!
والأساس في نشأة الدولة الوطنية، هو أنها تجمع بين أفراد يختلفون في ألوانهم وأنواعهم وأديانهم ومذاهبهم الدينية وأفكارهم السياسية، ينتمون لأرض محددة، اتفقوا فيما بينهم علي أن يصونوا حق كل منهم في أن يؤمن بما يشاء، ويصون حقه في أداء الشعائر الدينية للدين أو المذهب الذي يؤمن به،
وأن يتساووا جميعاً في الحقوق والواجبات، وصاغوا كل ذلك في دساتير، وانتخبوا حكومة لتطبقها، وليس من حق هذه الحكومة أن تنتقص من حق أحدهم، لمجرد أنه يدين بدين أو مذهب مختلف مهما كان رأيها فيه، إذ إن حسابه علي ذلك، يتم يوم الحشر العظيم، وأمام رب العزة!
تلك هي المسألة، أو المهزلة، التي قادنا العجز عن فهمها، إلي حرمان طفلتين مصريتين من أبسط حقوق المواطنة.. وهو أن تكون لكل منهما شهادة ميلاد لمجرد أنهما تدينان بما لا ندين ولا نؤمن به.

البهائيون.. ورقة ضغط جديدة ضد مصر

«إن البهائية مخالفة تماماً للشريعة الإسلامية، ولا يمكن لأحد أن يعترف بها كدين».. نص كلام الدكتور محمد سيد طنطاوي، شيخ الأزهر في لقائه بطلاب الجامعات المصرية في معهد إعداد القادة قبل عدة أسابيع، الذي شدد فيه شيخ الأزهر علي أنه لا ينبغي ألا يسمح بذكر لفظ بهائي في البطاقة الشخصية لأي بهائي، «لأن في ذلك اعترافاً بالبهائية كدين»، مذكراً بأن البهائية لم يعترف بها أحد في مصر، وأن وزارة الداخلية ومحكمة القضاء الإداري رفضت أن تجعل من البهائية صفة دينية تذكر في البطاقة الشخصية.
البهائيون من جانبهم دخلوا في معارك قضائية لإثبات «ديانتهم».
تحول البهائيون في مصر خلال الأعوام من ٢٠٠٥ وحتي العام ٢٠٠٨ إلي ورقة حقوقية تستخدم ضد مصر في مجال حقوق الإنسان وتشكل هاجساً أمنياً علي المستوي الداخلي والخارجي.
«المصري اليوم» حصلت علي وثائق وكتب وأوراق وشهادات ميلاد وأحكام قضائية حديثة وقديمة صنعت هذا التحقيق.
في عام ١٩١٥ تكون أول محفل محلي بهائي في القاهرة وبعد ذلك بعام واحد في ١٩١٦ شهدت مدينة بورسعيد أول أحداث عنف ضد بهائيين، وبعد ذلك بثماني سنوات وفي عام ١٩٢٤ شيد البهائيون أول محفل مركزي لهم في مصر.
المواقع البهائية تروي أن الإمام الشيخ محمد عبده شيخ الأزهر ذا المنهج التنويري قابل عبدالبهاء في بيروت، وفي حوار حول البابية والبهائية دار بين الأستاذ الإمام - علي حد وصفهم - والشيخ رشيد رضا، سأل الشيخ رضا عن رأي الأستاذ الإمام قائلاً: وماذا عن عباس أفندي، مؤسس البهائية؟ فأجاب: أسمع أنه بارع في العلم والسياسة، وأنه عاقل يرضي كل مجالس، فيجيب الأستاذ الإمام قائلاً: «نعم.. إن عباس أفندي فوق هذا، إنه رجل كبير، وهو الرجل الذي يصح إطلاق هذا اللقب - كبير - عليه.

وفي عام ١٩٢٥ صدر حكم محكمة بني سويف الكلية للأحوال الشخصية للولاية علي النفس بالجلسة الجزئية المنعقدة علناً بمحكمة «ببا» الشرعية في يوم ١٠ مايو، وصادقت عليه الدوائر الدينية العليا في القاهرة، صدر حكم بتفريق الأزواج في قضية الحسبة الجزئية المرفوعة من محمد أبوبكر هنداوي مأذون بلدة كوم الصعايدة التابعة لمركز ببا «مدعي حسبة» بإذن من وزارة الحقانية - العدل - بكتابها للمحكمة المؤرخ ٣١ مايو سنة ١٩٢٤ ضد حافظ محمد زيدان وزوجته حميدة بنت فرغلي حسانين، ومحمد عبده وزوجته بدرة بنت حسن عبده وحسن مرعي طنطاوي وزوجته آمنة بنت حسن أحمد الروبي المقيمين جميعاً بهذا البلد.
وحسبما يري البهائيون فإن هذا الحكم بالتفريق بين الأزواج صرح تصريحاً إيجابياً وتاريخياً حيث جاء في حيثياته «إن البهائية دين جديد قائم بذاته له عقائد وأصول وأحكام خاصة به تغاير وتناقض عقائد وأصول وأحكام الدين الإسلامي تناقضاً تاماً فلا يقال بهائي مسلم ولا العكس كما يقال بوذي أو برهمي أو مسيحي «مثلاً» مسلم ولا العكس، وهو ما اعتبروه إعلاناً بشكل مباشر باستقلال «الدين البهائي».

وبعد ٨٠ عاما وفي عام ٢٠٠٤ ذهب أحد البهائيين وهو المهندس حسام موسي وزوجته د. رانيا رشدي، إلي مصلحة الأحوال المدنية لوضع أسماء أطفالهم الثلاثة علي وثيقة سفر الأم وتقدموا بالأوراق المطلوبة لذلك، منها بطاقات الهوية وشهادات ميلاد الأطفال، وكان مدوناً بها الديانة بهائي.
وقام الموظف بسحب كل الأوراق الأصلية منهم وقال لهم استخرجوا غيرها مدوناً بها إحدي ديانات ثلاث، مسلم أو مسيحي أو يهودي، وذلك طبقاً للكتاب الدوري رقم ٤٩ لسنة ٢٠٠٤، في اللائحة التنفيذية لمصلحة الأحوال المدنية الصادرة من وزارة الداخلية المصرية، وعندما تظلم المواطن للوزارة قالوا له ارفع قضية بالمحكمة.
وتم رفع القضية لاسترداد هذا الأوراق في ١٠/٦/٢٠٠٤ واستمرت القضية حتي تم الحكم الإيجابي فيها في ٤ أبريل ٢٠٠٦ بمحكمة أول درجة وقال القاضي العادل فاروق عبدالقادر في حيثيات الحكم مستنداً علي حكم سابق للمحكمة الإدارية العليا ١٩٨٣: «إن دار الإسلام قد وسعت غير المسلمين علي اختلاف ما يدينون، يحيون فيها كسائر الناس بغير أن يكره أحد منهم علي أن يغير شيئاً مما يؤمن به».
وحكمت المحكمة: «وحيث إنه بتطبيق ما تقدم، وكان المدعيان يعتنقان البهائية ومن ثم فإن امتناع الجهة الإدارية عن إعطائهما بطاقة تحقيق شخصية ثابت فيها تلك الديانة، وكذا امتناعها عن إعطائهما شهادات ميلاد لبناتهم؟ باكينام وفرح وهنا، مثبت فيها الديانة بهائية، فإن ذلك يشكل قراراً سلبياً غير مشروع، وتقضي المحكمة بإلغائه مع ما يترتب علي ذلك من آثار أخصها إعطاء المدعيين بطاقات تحقيق شخصية وشهادات ميلاد لبناتهم مثبت بها جميعاً الديانة بهائية.
وفي ٢٨ أبريل ٢٠٠٦، أرسل باني دوجال الممثل الرئيسي لدي هيئة الأم المتحدة، خطاباً باسم الجامعة البهائية العالمية التي يترأسها إلي فضيلة الشيخ إبراهيم عطا الفيومي، أمين عام مجمع البحوث الإسلامية بالأزهر الشريف، وفضيلة الإمام الدكتور محمد سيد طنطاوي، رئيس مجمع البحوث الإسلامية وشيخ الأزهر الشريف بعد ١٤ يوماً من حكم المحكمة يقول فيه:

فضيلة الشيخ إبراهيم عطا الفيومي، أمين عام مجمع البحوث الإسلامية بالأزهر الشريف.
فضيلة الإمام الدكتور محمد سيد طنطاوي، رئيس مجمع البحوث الإسلامية وشيخ الأزهر الشريف.

لقد نمي إلي علم الجامعة البهائية العالمية ما نشرته جريدة «الأهرام» في عددها الصادر يوم ٢٦ من الشهر الجاري عن دراسة مجمع البحوث الإسلامية لكل ما يتعلق بالبهائية من مبادئ وأفكار إعداداً «لتقرير مدي شرعيتها من عدمه»، وقد أوضح الخبر في الجريدة المذكورة أن هذه الدراسة جاءت بناء علي خطاب رسمي من وزير العدل، ويبدو أن ذلك متعلق بالحكم الذي أصدرته مؤخراً المحكمة الإدارية وقضت بموجبه «أن امتناع الجهة الإدارية عن إعطاء البهائين بطاقة تحقيق شخصية ثابت فيها تلك الديانة، يشكل قراراً سلبياً غير مشروع تقضي المحكمة بإلغائه مع ما يترتب علي ذلك من آثار».
إن حكم المحكمة الإدارية واضح في أن المحكمة لم تبن حكمها علي شرعية الدين البهائي كعقيدة دينية، وإنما حصرت أسباب حكمها في مقتضيات تحديد هوية المدعين في سند رسمي بوصفهم بهائيين، فالمحكمة كانت بصدد الفصل في نزاع مدني: ألا وهو ضرورة إعطاء البهائيين كمواطنين مصريين وثائق هوية قررتها الدولة لجميع المواطنين علي نحو لا يرغمهم علي إنكار دينهم، هذا بالإضافة إلي ما رأته المحكمة من أنه «ليس يخالف أحكام (الشريعة) ذكر الدين في تلك البطاقة أو الشهادة، وإن كان مما لا يعترف بإظهار مناكسه»، فحكم المحكمة لا يعتمد علي أن ما يعتقده البهائيون هو حق، وإنما دعامته احترام القانون وحقوق الإنسان الأساسية.
فإذا ما رأي مجمع البحوث الإسلامية ضرورة إبداء رأيه في التعاليم البهائية، فإننا علي ثقة بضرورة تأسيسه هذا الرأي علي حقائق مستقاة من مصادر معتمدة بعيداً عن المفاهيم الخاطئة التي شاعت عن الديانة البهائية وموقفها من الشرائع السماوية الأخري ومنها الإسلام، وتقدم في هذا الصدد الفقرة التالية المقتطفة من بيان موجز عن الدين البهائي لحضرة شوقي أفندي رباني، ولي أمر الله عرضاً موجزاً لجانب من المعتقدات البهائية:
«إن الدين البهائي يؤمن بوحدانية الله، ويعترف بوحدة أنبيائه، ويرسخ في الأذهان مبدأ وحدة وتكامل الجنس البشري بأسره، ويعلن ضرورة وحتمية اتحاد البشر، ويؤكد أنهم يقتربون منه تدريجياً، كما ينادي بأن المشيئة الإلهية كما يظهرها المبعوث لهذا اليوم يمكنها وحدها في نهاية المطاف أن تحقق هذا الاتحاد، وفضلاً عن ذلك يأمر الدين البهائي أتباعه بالبحث الحر عن الحقيقة، ويرفض كل صور التعصب والخرافات، ويعلن أن غاية الدين هي الوفاق والوداد،
ويؤيد اتفاق العلم والدين، ويعترف بأن الدين هو العامل الأكبر في استقرار المجتمع الإنساني وتقدمه، ويتمسك بدون لبس بمبدأ المساواة بين الرجال والنساء في الفرص والحقوق والامتيازات، ويفرض التعليم الإجباري، ويقضي علي الفقر المدقع والثراء المفرط، ويلغي نظام الكهنوت، ويحرم الرق، والرهبنة والتنسك والاستجداء، ويأمر بالاكتفاء بزوجة واحدة، ويبغض الطلاق، ويركز علي ضرورة الطاعة التامة للحكومة، ويسمو بكل عمل يؤدي بروح الخدمة إلي مصاف العبادة، ويحبذ إيجاد أو انتخاب لغة تكون لغة ثانوية عالمية، ويرسم هيكل المنظمات الضرورية لتأسيس السلام العام بين الأمم والمحافظة عليه».
وتود الجامعة البهائية العالمية انتهاز هذه الفرصة لتقدم بياناً موجزاً عن الديانة البهائية إلي مجمع البحوث الإسلامية تسهيلاً لدراسته التي نأمل أن يكون أساسها الإنصاف الذي تقتضيه الأصول الشرعية ونتوقعه من المؤسسات الدينية العريقة مثل الأزهر الشريف ومجمع البحوث الإسلامية.
إن الجامعة البهائية العالمية يحدوها الأمل أن يعرب عرضها للتعاون والمساهمة في هذه الدراسة عن روح الاحترام المتبادل والتجاوب الودي التي حثت عليه، والمتوقع أن تسود العلاقة بين الهيئات الدينية في العالم.

ويبدو أن حكم المحكمة جعل الأزهر يعيد التنبيه إلي «خطورة» البهائية علي المجتمع، حيث جاء علي لسان شيخ الأزهر أن البهائية مخالفة تماماً للشريعة الإسلامية.
وهذا الموضوع قديم متجدد، حيث سئل فضيلة الشيخ حسنين مخلوف، مفتي الديار المصرية: «هل يجوز أن يرث البهائي المسلم»، فأفتي: «باعتناق هذا الرجل مذهب البهائية المعروف صار مرتداً عن الإسلام، لما عرف عن عقائدهم من أنها كفر صراح والمرتد عن الحنيفية يزول ملكه عن ماله زوالاً موقوفاً، فإن أسلم عاد إليه ملكه وإن مات علي ردته ورثه المسلم وأما كسب ردته فلبيت المال، وبشكل عام فالبهائيون خارجون عن الإسلام ولا يجوز مناكحتهم ولا توريثهم ولا دفن موتاهم في قبور المسلمين.
ورغم هذه الفتوي الصريحة، إلا أن وزارة التربية والتعليم في أسئلة امتحان شهادة إتمام الدراسة الثانوية العامة لعام ٢٠٠٤ في المرحلة الأولي - الدور الأول - جاءت مادة أخلاقيات غير المسلمين وغير المسيحيين، في زمن قدره ساعتان لتثبت أن الدولة تعامل مع البهائيين، حيث طلب الممتحن من الطلاب أن يكتبوا في الموضوع الآتي إجبارياً، وهو «الإخلاص في العمل وإتقانه وصولاً إلي الحضارة والرقي سمة تميز الدول المتحضرة عن غيرها».
كما طلب الكتابة في موضوعين اثنين من ثلاثة موضوعات، هي: «التسامح من شيم الكرام وهي صفة تقرب بين القلوب وتجعل من العدو وليا حميماً».
والسؤال الذي يليه هو «الصداقة سمة إنسانية ترتقي بالحياة متي قامت علي أساس من البر والإخلاص والوفاء».
أما السؤال الأخير فهو «الإحساس بالجمال في المسكن والمدرسة والتسامح خلق ضروري لمقاومة التلوث وتحقيق النهوض».
الدكتورة باسمة موسي تقول: كيف لا تعترف الدولة بالبهائية حالياً وهناك امتحانات لهم تشكل اعترافاً صريحاً بوجودهم وديانتهم، وأن هذه الامتحانات تكررت في عامي ٢٠٠٥، ٢٠٠٦.
وتتساءل: من قبل صدرت لنا شهادات ميلاد وبطاقات شخصية وعائلية، ماذا حدث الآن، إننا نواجه متاعب كبيرة في إلحاق أولادنا بالمدارس وإعلان زواجنا رغم أننا لا نعمل بالسياسة ولا يهمنا سوي أن تسود المحبة والسلام المجتمع.
وفي المقابل يقول الدكتور خالد السيوطي، في كتابه «البهائية.. عقائدها، أهدافها الاستعمارية» وهو الكتاب الذي نشرته وزارة الأوقاف والمجلس الأعلي للشؤون الإسلامية عن سلسلة دراسات إسلامية عام ٢٠٠٦:
مقاومة المجتمع الإسلامي لهذه البدعة.

لقد عارض الشعب الإيراني وعلماؤه وحكومته هذه البدعة حين ظهورها، وناظروا مبتدعها الأول «الباب» وحكم عليه بالردة وأُعدم في تبريز في شهر يوليو سنة ١٨٥٠، وحين وفدت هذه البهائية إلي مصر قاومتها كل السلطات علي الوجه التالي:

أولاً: ١- أفتي الشيخ سليم البشري شيخ الجامع الأهر بكفر «ميرزا عباس» زعيم البهائيين ونشرت في جريدة مصر الفتاة في ٢٧/١٢/١٩١٠ بالعدد ٦٩٢.
٢- صدر حكم محكمة المحلة الكبري الشرعية في ٣٩/٦/١٩٤٦ بطلاق امرأة اعتنق زوجها البهائية باعتباره مرتداً.
٣- أصدرت لجنة الفتوي بالأزهر في ٢٣/٩/١٩٤٧، وفي ٣/٩/١٩٤٩ فتويين بردة من يعتنق البهائية.
٤- صدرت فتاوي دار الإفتاء المصرية في ١١/٣/١٩٣٩، وفي ٢٥/٣/١٩٦٨، وفي ١٣/٤/١٩٥٠ بأن البهائيين مرتدون عن الإسلام.
٥- وأخيراً أجابت أمانة مجمع البحوث الإسلامية علي استفسار نيابة أمن الدولة العليا عن حكم البهائية، بأنها نحلة باطلة لخروجها عن الإسلام بدعوتها للإلحاد والكفر، وأن من يعتنقها يكون مرتداً عن الإسلام.
ثانياً:
عندما سجل البهائيون محفلهم في المحاكم المختلطة برقم ٧٧٦ في ٢٦/١٢/١٩٣٤، حاولوا أن يوجدوا لهم صفة الشرعية لكن الحكومة قاومتهم ويتضح هذا مما يأتي:
١- قدم المحفل الروحاني المركزي للبهائيين بمصر والسودان، طلباً إلي وزارة الشؤون الاجتماعية لتسجيله، وقد رفض هذا الطلب بناء علي ما رأته إدارة قضايا الحكومة في ٥/٧/١٩٤٧.
كما رفض طلب صرف إعانة له من هذه الوزارة.
٢- رأت إدارة الرأي بوزارتي الداخلية والشؤون البلدية والقروية في ٨/١٢/١٩٥١ أن في قيام المحفل البهائي إخلالاً بالأمن العام، وأنه يمكن لوزارة الداخلية منع إقامة الشعائر الدينية الخاصة بالبهائيين.
قد تأيد هذا بما رآه مجلس الدولة في ٢٦/٥/١٩٥٨ من عدم الموافقة علي طبع إعلان دعاية لمذهب البهائية لأنه ينطوي علي تبشير غير مشروع، ودعوة سافرة للخروج علي أحكام الدين الإسلامي، وغيره من الأديان المعترف بها، ورأي منع ذلك لمخالفته للنظام العام في البلاد الإسلامية.
٣- حكمت محكمة القضاء الإداري بمجلس الدولة في مصر في القضية رقم ١٩٥ لسنة ٤ق بتاريخ ٢٦/٥/١٩٥٢ برفض دعوي أقامها بهائي وجاء في تسبب هذا الحكم تقريرها: إن البهائيين مرتدون عن الإسلام.
٤- صدر القرار الجمهوري رقم ٢٦٣ لسنة ١٩٦٠ ونص في مادته الأولي علي أنه: تحل المحافل البهائية ومراكزها الموجودة في الجمهورية ويوقف نشاطها ويحظر علي الأفراد والمؤسسات والهيئات القيام بأي نشاط مما كانت تباشره هذه المحافل والمراكز.
ونص في مادته الأخيرة علي تجريم كل مخالف وعقابه بالحبس وبالغرامة.
٥- وتنفيذاً لهذا القرار بقانون أصدر وزير الداخلية قراره رقم ١٠٦ لسنة ١٩٦٠ بتاريخ ٣١/٧/١٩٦٠ بأيلولة أموال وموجودات المحافل البهائية ومراكزها إلي جمعية المحافظة علي القرآن الكريم.
٦- حكم بالحبس والغرامة في القضية رقم ٣١٦ لسنة ١٩٦٥ علي عناصر من أتباع البهائية لقيامهم بممارسة نشاطهم في القاهرة، كما قبض علي غيرهم في طنطا في سنة ١٩٧٢، وكذلك في سوهاج.
٧- قبض علي مجموعة منهم أخيرًا في فبراير سنة ١٩٨٥ برئاسة أحد الصحفيين وقد اعترفوا بإيمانهم برسولهم بهاء الله وكتابهم المقدس، وأن قبلتهم جبل الكرمل بحيفا في إسرائيل.
وقد وجهت إليهم تهمة مناهضة المبادئ الأساسية التي يقوم عليها نظام الحكم في البلاد والترويج لأفكار متطرفة بقصدر تحقير وازدراء الأديان السماوية الأخري.
٨- أوصي المؤتمر العالمي الرابع للسيرة والسنة النبوية، بتجريم هذا المذهب وتجريم معتنقيه.

An Egyptian court on Tuesday ruled that members of the Bahai Faith can get new ID cards that don’t state their religious affiliation, ending four years of court controversies, including rulings that denied Bahaism exists as a religion.

The decision followed an appeal filed by two Bahai families who were refused ID cards by the Egyptian interior ministry because their religion is not recognized under the law here.

Egypt recognizes only Judaism, Christianity and Islam and requires all identification papers and other documents, such as birth certificates, to state an individual’s religion.

The court said the Bahais would be “allowed to put a hyphen” in the “religion” column in documents, instead of filling it out. The two Bahai families had asked the court allow them to leave the column blank.

The Supreme Administrative Court in Cairo also stated that Bahaism is not a recognized religion in Egypt. “The officially recognized religions are Judaism, Christianity and Islam, and there are no other recognized religions,” it said.

The phrasing reflected a compromise – while not going against the law, it allowed for the Bahais, who are estimated to number about 2,000 in Egypt, to get documents.

The Bahai Faith was founded in the 1860s by a Persian nobleman, Baha’u’llah, who claimed to be a new prophet in the series of prophets that included Moses, Jesus and Muhammad. Islam considers Muhammad to be the last of the prophets.
