Egyptian Baha'i Child Denied Birth Certificate - Al-Badeel Newspaper

The Child was born in 9th November 2008 and still couldn't get a birth certificate because he is Baha'i. This news item was published in today's edition of Cairo's Al-Badeel newspaper .

The baby's father told the newspaper that this means that his newborn child cannot be counted in Egypt's census, he cannot be vaccinated against serious infectious diseases and that the baby's mother cannot obtain maternal leave from her employment.

This newborn can be now added to a long list of Egyptian children, born to Baha'i parents, who live in the shadows, and whose existence their own government has denied. They are deprived of all their human and civil rights, including the rights to health care and education.

The circular in the right was distributed by the Department of Civil Status in July to its branches and health centers in which it affirms that only three religions (Judaism, Christianity or Islam) can be listed under the religion field!
By doing so, Egypt continues to be in gross violation of all international covenants that guarantee the rights of man, to which Egypt is a co-signatory.

The Department of Civil Status Leads the Discrimination Against Baha’is

In 2004, an administrative decision by Egypt’s “Department of Civil Status” allowed for only three religions - Islam, Judaism and Christianity - to be listed under the religion field in identification papers, lamentedly denying thousands of Baha’is their right to the simplest of civil rights. Some of the hurdles faced by Egyptian Baha’is, are explained below:

Birth certificates aren’t issued to Baha’i infants. A child’s denial of her/his right to a birth certificate has detrimental effects throughtout her/his lifetime, as it prevents access to health care and education. Further, working mothers aren’t entitled to maternity leave due to the absence of a birth certificate.

Apart from the risks entailed in not being able to produce a National ID card, should a brush with law enforcement officials ever occur, its lack automatically denies Baha’is from gaining employment, attaining higher education, deferring mandatory conscription, authenticating formal papers, dealing with financial institutions, etc.

Baha’i youth cannot determine their position when it comes to conscription, because they lack National ID cards. As a result, many have been suspended from universities.

Bahai’s in Egypts are not issued death certificates, thus denying widow(er)s and orphans from obtaining pension. btaining passports is out of the question, as the process requires a National ID card. Baha’i marriage certificates are not recognized by the state. This prevents spouses from travelling freely and prevents their future children from obtaining birth certificates.

Egyptian Baha’is cannot seek court protection or demand their rights in the upcoming period as they do not possess ID cards.

Despite the January 29 ruling, the Department of Civil Status has shown signs of willingness to alter its position, justifying it by resorting to fatwas (religious edicts) that claim there are only three divine religions

مصلحة الأحوال المدنية تقود التمييز ضد البهائيين

أبسط تعريف للمواطنة أنها انتماء الأفراد إلي مجتمع معين تترتب عليه واجبات متبادلة بين الفرد ومجتمعه، أهمها الولاء من جانب الفرد في مقابل الحماية من جانب المجتمع، فتهيئ له الفرص لتنمية مواهبه وتحسين عيشه. فالمواطنة بهذا المعني سابقة علي الدساتير والقوانين

ونتاج التاريخ المشترك والمسيرة الجماعية التي صهرت التفرقة بين مواطن وآخر، مهما كان أصله أو لونه أو جنسه أو معتقداته، فخلقت شراكة بين سواسية يربطهم التآزر والتكافل والتراحم. وليس الدستور والقانون سوي ترجمة لهذه المشاعر والمبادئ علي أرض الواقع، بروح تدعم الوحدة الوطنية علي أساس تعضيد الانتماء والاندماج، لا إقصاء فيها ولا إهمال. إن المساس بحقوق المواطنة يهدد سلامة المجتمع، ويسقط حق الوطن، فبدون ضمان حقوق المواطنين تضعف مشاعر المواطنة، فتتهيأ الفرص لظهور الطائفية، والرجوع إلي نزعات الشعوبية والجاهلية التي تستنكرها الحضارة المعاصرة.فمنذ صدور آخر هذه الأحكام في29 يناير الماضي لم تظهر في الأفق أي بارقة تبشر بتغيير مصلحة الأحوال المدنية لموقفها السابق. ذلك الموقف الذي يزداد -مع مرور الأيام- وضوح مخالفته النظام العام، ومنافاته الصالح العام في المجتمع المصري. بعد أن انتهي القضاء الإداري إلي إقرار حقوق المواطنة وضماناتها الدستورية باعتبارها مانعاً من التمييز في معاملة المواطنين بسبب الجنس أو اللون أو الدين أو المعتقد، وباعتبار أن المساواة أمام القانون تجبّ الحجة التي طالما استندت إليها إدارة الأحوال المدنية في الماضي لحرمان البهائيين من أوراقهم الثبوتية، واعتمادها في ذلك علي فتاوي تختزل الأديان السماوية في ثلاثة أديان لا غير، بالرغم من مناقضة تلك الفتاوي لطبيعة المجتمع المصري وتراثه، وتعارضها مع الالتزامات الدولية والضمانات الدستورية، ومخالفتها الكتب السماوية التي تذكر نصوصها وآياتها الكثير من رسل الله وأنبيائه ولا تحصرهم في عدد محدود.

وأياً كان الأمر فإن أحكام القضاء الإداري الخاصة بجواز ترك خانة الديانة في أوراق الهوية للبهائيين شاغرة، لم يقتصر في الواقع علي مجرد الحكم بعدم قانونية ما أصرت عليه مصلحة الأحوال المدنية سابقاً وأمرها بإلغاء كل ما يترتب عليه فحسب، بل تضمنت هذه الأحكام أيضاً تفسير قانون الأحوال المدنية علي نحو يستبعد التمييز بين المواطنين بسبب انتمائهم الديني أو العقائدي. ومع ذلك ما زالت مصلحة الأحوال المدنية تتعثر في خطاها نحو اتخاذ الخطوات الإيجابية لتعديل موقفها

ويهمنا التنويه بأن التزام إدارة الأحوال المدنية بإصدار أوراق الهوية للبهائيين لابد ألا يكون منوطاً بتنفيذ الأحكام الصادرة لفئة منهم، وإنما لابد أن يكون التزاماً أصلياً نابعاً من مواطنتهم، ومعتمداً علي الحقوق والحريات الدستورية المترتبة علي ثبوت هذه المواطنة. ووضع حد للأضرار التي تصيب مصالحهم الحيوية نتيجة عدم حصولهم علي هذه الأوراق حتي الآن

فمازالت النتائج السلبية المؤلمة للقرار الإداري رقم 49 لسنة 2004 في الكتاب الدوري للائحة التنفيذية لمصلحة الأحوال المدنية بإثبات ثلاث ديانات فقط في الأوراق الثبوتية تحرم المواطن البهائي من أبسط حقوق المواطنة والتعرض للتمييز في مجالات التعليم والتوظيف وتسجيل المواليد واستخراج شهادات وفاة وتحصيل المعاش علي النحو التالي

شهادة الميلاد: عدم إصدار شهادات الميلاد مع ما يترتب علي ذلك من عدم الحصول علي التطعيم اللازم لحماية الطفل من الأمراض والأوبئة، وعدم الحصول علي التأمين الصحي للأطفال، ثم عدم قبولهم في المدارس. وفي حالة المرض لن يتمكن الطفل طوال حياته من دخول المستشفيات للعلاج أو الحصول علي علاج علي نفقة الدولة. ولا تستطيع الأم العاملة أن تأخذ إجازة وضع أو إجازة رعاية طفل لعدم وجود شهادة ميلاد

بطاقة الرقم القومي: وغني عن الذكر المخاطر التي يتعرض لها المواطن إذا كان عاجزاً عن تقديم بطاقة هوية إذا تصادف وطالبته الشرطة بإظهار هويته. ولا يمكن الحصول علي عمل ولا التحصيل في الجامعات ولا تأجيل التجنيد لمن هم في الجامعات حالياً، أو التعامل مع المؤسسات المالية والبنوك أو توثيق العقود الرسمية، أو البيع والشراء......... إلخ

الموقف من التجنيد: لا يستطيع الشباب البهائي تحديد الموقف من التجنيد بسبب بطاقة الهوية. وقد تم فصل عدد من طلبة الجامعة لهذا السبب

عدم الحصول علي شهادة وفاة والذي يترتب عليه عدم الحصول علي المعاش بعد ذلك للأرامل والأبناء

تعذر الحصول علي جواز السفرالجديد حيث يتطلب ذلك تقديم بطاقة الرقم القومي

عدم الاعتراف بوثيقة الزواج البهائي علي الرغم من توقيع ثمانية أفراد بالغين علي صحة هذا العقد. والذي يعقبه :عدم استخراج شهادات ميلاد لأبنائهم ويتعرض الأطفال لعدم شرعيتهم. كما أن الزوجين لا يستطيعان التحرك بسهولة كزوجين مثل الإقامة في الفنادق أو التعرض للسير في الطريق العام وعدم إعطاء الجنسية المصرية للأجنبي الذي يتزوج مصرية أو العكس

تعذر اللجوء إلي حماية القضاء أو المطالبة بحقوقنا في الفترة القادمة لعدم وجود بطاقة رقم قومي الذي يشترطه مكتب الشهر العقاري الآن لاستخراج توكيل قضايا

ولا يقتصر ما يعانيه البهائيون منذ سنوات علي حل هيئاتهم الدينية أو محاكمات جائرة أو عدم الاعتراف بهويتهم أو التمييز الديني ضدهم بل هناك العديد من المصاعب الأخري، مثلا يواجه الأطفال البهائيون الآن عدم القبول بالمدارس لعدم حصولهم علي شهادة ميلاد مميكنة- بعد أن كان الطلبة البهائيون منذ أعوام طويلة عند التقدم لامتحان الثانوية العامة يترك لهم الخيار لأداء الامتحان في الديانة الإسلامية أو المسيحية أو مادة الأخلاقيات وذلك بعد كتابة الديانة بهائي في استمارة دخول الامتحان ثم بدأت الوزارة هذا العام في التضييق علي البهائيين لإجبارهم علي عدم ذكر ديانتهم وكتابة إحدي الديانات الثلاث في النظام الإلكتروني الجديد للتسجيل لامتحان الثانوية العامة، التي سيجري بها العمل نهائيا العام القادم والتي تشترط اختيار إحداها لكي يستطيع الطالب أن يطبع الاستمارة وتسليمها للمدرسة بعد ذلك. أما إذا لم يختر الطالب أياً من الديانات الثلاث فلن يستطيع طبع الاستمارة و لن يستطيع الطالب دخول الامتحان

إننا نرحب بموقف الحكومة المصرية بإدراج مبدأ المواطنة كمادة أولي في الدستور المصري والتي مهدت الطريق لحلول فهم جديد لحقوق المواطنة والحريات الدينية في مصر؛ فهم طليق من قيود التعصب وعقال التمييز بين أبناء الوطن الواحد بسبب انتماءاتهم الدينية وعقائدهم الخاصة. وإلي أن تضع مصلحة الأحوال الشخصية هذا المبدأ موضع التنفيذ، لن يمكننا التخلص من الحيرة والتساؤل عن علّة تردد مصلحة الأحوال المدنية في إصدار أوراق الهوية للبهائيين وقعودها في صمت مطبق عن مسايرة التفسير الصحيح لقانون الأحوال المدنية كما انتهي إليه القضاء الإداري

Schools reject enrollment papers of Bahai children - Daily News

CAIRO: Local schools are denying Bahais the right to enroll their children, five months after an Egyptian court recognized the right of members of the minority religion to leave the religious affiliation field on birth certificates and ID cards blank.
Adel Ramadan, a lawyer with the Egyptian Initiative for Personal Rights (EIPR) — which brought the case that was ruled on in January — says that schools are refusing to accept personal identity documents printed on paper.
Egypt recently replaced handwritten personal identity documents printed on paper with computerized ones, but the Ministry of Interior has reportedly been stalling on issuing them for Bahais.

While under the system involving paper documents the religious affiliation field on birth certificates and ID cards could be left blank, a 2006 Supreme Administrative Court decision held that Bahais had to either list themselves as Muslim, Christian or Jew (the only religions recognized in Egypt) or be denied the official documents necessary for them to access state services such as education and healthcare.

The effect of the policy was to force Bahais to commit fraud by falsely listing a religious denomination in order to obtain the documents necessary for them to open bank accounts, apply for jobs and enroll in school.

The Administrative Court, which overturned this verdict in January, stated that even though Bahais do not belong to one of the three religions officially recognized by the state, they enjoy the right to refuse to identify themselves as one of these religions. It also said that members of the Bahai faith have the right to access state services.

The Interior Ministry, however, has been slow in implementing the court decision and producing identity cards with a blank religious affiliation field.

EIPR director Hossam Bahgat told Daily News Egypt in April that the Interior Ministry had asked for more time in order to prepare for the implementation of the decision.

According to a report published in Arabic-language daily Al-Masry Al-Youm, school officials claim that they cannot accept identity papers in which the religious affiliation field is left blank.
Ramadan says that the decision was taken in pursuance of the state’s policy of forcing people to issue the new computerized identity papers, but has the effect of discriminating against Bahais who either hold the old paper identity documents or have not been issued new documents following the Interior Ministry’s failure to implement the Administrative Court’s decision.
“In pursuing this policy the Education Ministry is in breach of the constitution,” Ramadan told Daily News Egypt.

“The ministry is obliged to accept what are valid, official documents produced by the Interior Ministry.

“The Interior Ministry itself must implement the Administrative Court ruling and issue identity papers with a blank religious affiliation field,” he continued.

CAIRO (Reuters) - Official foot-dragging means Egypt's Baha'i religious minority is still struggling to get identity papers, despite a landmark court ruling seen as a challenge to the Muslim religious establishment, a rights group says.

A January court ruling lets the unrecognised Baha'i minority obtain state documents if they omit their faith. Baha'is regard their faith's 19th-century founder as the latest in a line of prophets including Abraham, Moses, Buddha, Jesus and Mohammed.

The Egyptian Initiative for Personal Rights said that three months after the court ruling, it was still unable to obtain proper identity documents for the teenage twins of Raouf Hindy, who had brought the legal case, or for any other Baha'is.

But the government had also not filed an appeal in the Baha'i case during a 60-day appeals period, raising optimism that the ruling would ultimately be put into effect, if slowly.
"We are encouraged by the positive signal that they did not appeal. But we think that all the necessary changes should not take three months," said Hossam Bahgat, head of the Egyptian Initiative, which represented the Baha'is in court.

Interior Ministry officials could not immediately be reached for comment. Bahgat said officials had told Baha'is who sought identity papers that they needed more time to implement changes.
The ruling should give members of Baha'i community access to documents, largely denied them since 2004, needed to marry, enrol in school, drive a car, or open a bank account.
