Egypt: A Baha'i Blogger's Take on the Elections

Wael speaks to Global Voices Online about the current situation of the Baha'is in Egypt and the changes that the current elections might bring.

Global Voices Online has spoken to Wael, who blogs at Living in Egypt without ID, about the current situation of the Baha’is in Egypt and the changes that the current elections (stage two of which starts on December 14) might bring.

Global Voices (GV): What is the current situation for the Baha’is in Egypt? What are the main problems the community faces?

Wael: As you know, identification documents, especially identity cards and birth certificates, are mandatory for all Egyptians and necessary to obtain access to education, employment, family life, registration and immunization of children, as well as most basic daily activities such as opening a bank account, obtaining a driver’s license, receiving pension or inheritance, or engaging in business transactions.

Most of the Egyptian Baha’is do not have official IDs to allow them to attain any of the above. In addition, they have been barred from holding government jobs, and that situation has not changed as yet. Baha’i marriages are still not recognized in Egypt, and that results in difficulties in obtaining birth certificates for Baha’i children.

While the Supreme Administrative Court ruled that Baha’is should be able to obtain official Egyptian identification cards, the implementation of this ruling has moved very slowly. A few Baha’is were successful in obtaining their IDs with a dash “—“ in the space designated for religion instead of adding the word Baha’i. However, the majority of Baha’is, including myself, have not been successful in obtaining official IDs. The major issue is providing required evidence that their parents were listed as Baha’is or have dashes in the space designated for religion in their IDs, same thing for their birth certificates. On the other hand, married couples can’t obtain official IDs since the Egyptian government does not recognize Baha’i marriage. Therefore so many Baha’is find themselves in a Catch-22 situation. Married or divorced Baha’is are unable to obtain their IDs. The Baha’is in Egypt are determined to obtain their citizenship rights and overcome the bureaucratic hurdles in implementing the Supreme Administrative Court’s decision.

Baha’i centers, properties, libraries, land for a House of Worship, and cemeteries that were confiscated by the Egyptian government in 1960 have not been returned to the Baha’is in Egypt. Baha’is are still banned from forming spiritual assemblies in Egypt. Naturally, the Baha’is in Egypt will continue to practice their religion inside their own homes.

GV: What do you think the result of the current elections will be? Do you feel there will be any changes for the Baha’i community?

Wael: Baha’is are quite optimistic about the future of their country in the long-term. However, Egypt is currently facing problems of corruption and divisions that have been perpetuated and exacerbated by the “divide and rule” mentality. Baha’is call their fellow citizens to unite in their pursuit of freedom, democracy, and development. All Egyptians need to live in dignity. They need a decent education for their children and youth; all expect to be treated equal regardless of their religion or beliefs. Egyptians uphold the rights of women to participate fully in all aspects of human endeavor. Finally, Egyptians have the responsibility to make these goals happen.

Baha’is believe that all people should be treated with respect, dignity and equality, regardless of their social and economic status and of their gender or religion. They will continue to demand their human and civil rights. Baha’is will contribute their part of promoting unity, dignity, and freedom. To quote Baha’u’llah, the prophet founder of the Baha’i faith, “So Powerful is the light of unity that it can illuminate the whole earth.” Egyptians are in a unique position to determine their country’s own unique model of democracy and not blindly follow existing models founded on consumerism and rampant greed. Such a system can reflect the ideals of our youth: good moral character, respect, responsibility, and humility to uphold this generation’s ideals of justice, fairness, freedom, and compassion for all. Egyptian society possesses the potential to evolve a new unique system that is based on personal responsibility, compassion, and serving the common good, and not on greed, fear, and division.

GV: Baha’i teachings prohibit Baha’is from getting involved in partisan politics; does this mean they can't vote in the elections?

Wael: While Baha’is refrain from getting involved in partisan politics, they nonetheless participate in the political process by casting their votes for candidates who in their opinion combine the qualities of unquestioned loyalty, of selfless devotion, of a well-trained mind, of recognized ability and mature experience. Baha’is prefer to focus on the politics of unity rather than division. They do not vote in blocs nor do they endorse a specific candidate or party. Baha’is who are in possession of their IDs can participate in the elections. However, most Baha’is are unable to vote in the elections, as they do not have the official IDs.

GV: Are there other ways Baha’is can get involved in movements for progress in society?

Wael: Baha’is are involved through their jobs, schools, universities, homes, and neighborhoods of promoting unity, as they believe in the oneness of God, the oneness of His Religion, and the oneness of humanity. In their work and day-to-day living, they are committed to serve their neighborhoods and society, as in the Baha’i teachings work performed with the intent to serve humanity is equated with worship.

Iranian professionals post public apology to Baha'is - February 6, 2009 - CNN

TEHRAN, Iran (CNN) -- A group of Iranian intellectuals released a public apology this week for what they say is a long history of the country's mistreatment of members of the Baha'i faith.

The apology -- titled, "We are ashamed" -- was published on the Web site Iranian.com and was signed by 42 Iranian professionals, all of whom do not live in Iran.
"As Iranian human beings, we are ashamed for what has been perpetrated upon the Baha'is in the last century and a half in Iran," the letter says.
In the letter, the group detailed incidents of violence and discrimination that it says the Iranian government has perpetrated against Baha'is.
The Islamic republic has been condemned by human-rights activists and governments across the globe for its treatment of members of the Baha'i faith.
The Baha'i movement has said that six of its followers were arrested in January in Tehran, including one who works with Nobel peace laureate Shirin Ebadi, the lawyer and activist. Seven leaders of the group arrested in 2008 also remain in jail.
Members of Baha'i -- who say they are targeted in the predominantly Shiite nation because of their faith -- have faced arrests and other oppression over the years.
They say the persecution is part of a pattern that began in 1979. That's when the monarchy of the Shah of Iran was toppled and an Islamic republic was created.
Baha'i -- regarded as the largest non-Muslim religious minority in Iran -- claims to have 5 million members across the globe and about 300,000 in Iran.
The European Parliament passed a resolution in January that criticized Iran's treatment of Baha'is. The U.S. State Department also criticized Iran's treatment of Baha'i followers in a report last year.

!يكفي قرن ونصف من الاضطهاد والسكوت

{هذه العريضة كتبتها مجموعة من الأكاديميين، والمؤلفين، والفنانين، والصحفيين، والناشطين الإيرانيين المقيمين في كل أرجاء العالم. كما وقَّع عليها العديد من أبرز المثقفين الإيرانيين}

!إننا نستحي
!يكفي قرن ونصف من الاضطهاد والسكوت

Conflict of speech of Mr. Tantawy the head of the Alazhar Islamic supreme institution in Cairo about the Bahá’í Faith - July 19, 2008 – First Episode

Warning from Mr. Tantawy from recognition of the Bahá’í Faith in Egypt. He mentioned that recognizing the Bahá’í Faith in Egypt will be against Islam believes, and against all other religions believes. He described the Bahá’ís as a wicked group that will spread its poison among the Islamic countries.

He declared that the Bahá’ís of Egypt should never be allowed to state their religion in official documents since that act would automatically imply the recognition of the Baha'i religion in Egypt.
Previous speech with Mr. Tantawy two years ago (9-19-2006) with Alwatany Alyom, an Egyptian Newspaper, he responded to a question about his opinion to allowed the Egyptian Bahá’ís to write their religion in the Government ID cards. He said, “Yes they could write Bahá’í, why not? If they believe in this religion and when they do so they will make other religions freed from their guilt, and also to prevent the Bahá’ís from pretending to write other religions in their Government ID cards.

The bloger opinion:

The conflict of two speeches of Mr. Tantawy the head of the Alazhar Islamic supreme institution in Cairo is reflecting that he can’t make up his opinion on one of the important issues of religion believe, and he is trying to play different instruments reflecting the political views at each time of his speeches.

In reflecting to both speeches of Mr. Tantawy, we could clearly identify that Mr. Tantawy is imposing to create hatred among the Egyptian society against the Egyptian Bahá’ís and other minority.

Are these the principles of Islam that Mr. Tantawy teaches in Alazhar Islamic University?

Resolution 1303 at U.S. Congress is calling on the Egyptian Government to respect human rights and freedoms of religion and expression in Egypt

IN THE HOUSE OF REPRESENTATIVES
US Congress
June 24, 2008

The Resolution 1303 is calling on the Egyptian Government to respect human rights and freedoms of religion and expression in Egypt.

Whereas the promotion of respect for democracy, human rights, and civil liberties are fundamental principles and aims of the United States;

Whereas the United States attaches great importance to relations with Egypt and considers fair and transparent elections as the only way to make progress towards a more democratic society;

Whereas Egypt plays a significant role in the Middle East peace process and in the fight against international terrorism and fundamentalism;

Whereas the Egyptian authorities have promised to put an end to the imprisonment of journalists and bloggers, but this promise has so far gone unfulfilled;

Whereas Shiites, Koranists, Jehovah's Witnesses, and other religious minorities are harassed, arrested, and imprisoned by security services;

Whereas all Baha'i institutions and community activities have been banned in Egypt since 1960, and members of the Baha'i faith are denied government required identification cards solely due to their religious affiliation;

Whereas material vilifying Jews appears regularly in the state controlled and semi official media;
Whereas the Copts, Egypt's largest religious minority group and the largest Christian population in the Middle East, suffer from many forms of discrimination, including--

A lack of employment in higher positions of the public sector, universities, army, and the security service;

Disproportional representation in Parliament and Shura Council;

Difficulty in building and repairing churches;

lack of protection and lack of prosecution of perpetrators in cases of sectarian violence;

Government harassment of converts to Christianity while the government encourages conversion to Islam; and

The inability to obtain government issued identification cards which reflect conversion to Christianity;

Whereas the recent arrests and action against nongovernmental organizations and human rights defenders undermines the commitments entered into by the Egyptian Government concerning fundamental rights and freedoms and the democratic process in the country: Now, therefore, be it Resolved, That the House of Representatives--

Recognizes that respect for human rights is a fundamental value, and the bilateral relationship between the United States and Egypt should be a platform for promoting the rule of law and fundamental freedoms;

Calls on the Egyptian Government to end all forms of harassment, including judicial measures, the detention of media professionals and, more generally, human rights defenders and activists calling for reforms and to fully respect freedom of expression, in conformity with article 19 of the United Nations International Covenant on Civil and Political Rights;

Encourages the Egyptian Government to honor its commitment to repeal the state of emergency in order to allow for the full consolidation of the rule of law in Egypt;

Encourages the Egyptian Government to take the steps necessary to fully implement and protect the rights of religious minorities as full citizens;

strongly supports measures to guarantee academic freedom, freedom of the media, and freedom of religion or belief in Egypt, including by ending arbitrary administrative measures, such as those taken against the Centre for Trade Union and Workers' Services and the Association for Human Rights Legal Aid;

stresses the need for respect and protection of the freedoms of thought, conscience, and religion as ensured in article 18 of the Universal Declaration of Human Rights, article 18 of the International Covenant on Civil and Political Rights, and the 1981 United Nations Declaration on the Elimination of All Forms of Intolerance and of Discrimination based on Religion and Belief;

Urges the President and the Secretary of State to put human rights and religious freedom developments in Egypt very high on the United States Government's agenda during meetings with Egyptian officials.

Annual report of the U.S. State Department on Human Rights

annual report of the US State Department on human rights around the world. Released on March 11, 2008

Egypt 2008

Freedom of Religion

The constitution provides for freedom of belief and the practice of religious rites; however, the government restricted the exercise of these rights. According to the constitution, Islam is the official state religion and Shari'a (Islamic law) the primary source of legislation. Religious practices that conflict with the government's interpretation of Shari'a are prohibited. Members of non-Muslim religious minorities officially recognized by the government generally worshiped without harassment and maintained links with coreligionists in other countries. Members of religions that are not recognized by the government, particularly the Baha'i Faith, experienced personal and collective hardship.

Approximately 90 percent of citizens are Sunni Muslims; less than 1 percent are Shi'a Muslims. Estimates of the percentage of Christians ranged from 8 to 12 percent, or between 6 and 10 million, the majority of whom belonged to the Coptic Orthodox Church. There are small numbers of Mormons and Jehovah's Witnesses, but the government does not recognize either group. The non-Muslim, non-Coptic Orthodox communities ranged in size from several thousand to hundreds of thousands. The number of Baha'is is estimated at 2,000 persons.

The law bans Baha'i institutions and community activities and stripped Baha'is of legal recognition. The government continued to deny civil documents, including ID cards, birth certificates, and marriage licenses, to members of the Baha'i community. The MOI requires identity card applicants to self-identify as Jew, Christian, or Muslim. As a result, Baha'is face great difficulties in conducting civil transactions, including registering births, marriages and deaths, obtaining passports, enrolling children in school, opening bank accounts, and obtaining driver's licenses. During the year, Baha'is and members of other religious groups were compelled either to misrepresent themselves as Muslim, Christian or Jewish, or go without valid identity documents. Many Baha'is chose the latter course.

By September 30, all citizens had to obtain new computer identification cards or risk detention; however, the government did not enforce this requirement. In December 2006 the Supreme Administrative Court overturned a lower court ruling, deciding that Baha'is may not list their religion in the mandatory religion field on obligatory government identity cards. In May 2006 the MOI successfully appealed an administrative court ruling issued in April 2006, which supported the right of Baha'i citizens to receive ID cards and birth certificates with the Baha'i religion noted on the documents. The government issued passports, which do not indicate the holder's religion, for Baha'i citizens.

In February the EIPR filed a lawsuit on behalf of Hosni Hussein Abdel-Massih, who was suspended from the Suez Canal University's Higher Institute of Social Work due to his inability to obtain an identity card because he is a Baha'i. Students must produce a military draft postponement to complete their university education without interruption; however, one cannot obtain a military draft number without being issued a national ID number and a national ID card. The case was pending at year's end.

On September 10, the NCHR organized a workshop to discuss the issue of religious identity on ID cards. General Aly Abdel Mawla, Head of General Administration for Legal Affairs in the MOI, opposed the suggestion that the government allow the religion field to be left blank, asserting that the policy of requiring the indication of religious affiliation aims to protect freedom of religion.

In October Raouf Hindi Halim, a Baha'i convert, filed suit against the government to issue birth certificates for his twin daughters with the religion field left blank or to write (Baha'i) in the field. The case was postponed several times since it was first brought before the administrative court in 2004. Halim obtained birth certificates for the children when they were born in 1993 which recognized their Baha'i religious affiliation, but new certificates were mandatory, and the children were unable to enroll in public schools without them. The case remained pending at year's end.Du
